Attack on minister : Saradhamani gets bail

The district sessions court, Puri today, granted bail to Saradhamani Mahapatra, the 70-year old mother of the murdered former BJD councillor Talachhu Bhagaban Mohapatra alias Guna Singhari, in the case pertaining to the murderous assault on Odisha Law, Tourism and Culture minister Maheswar Mohanty on February 21.
The hearing on the bail petition had been deferred to March 12, as the police failed to submit its case diary on March 10.
Earlier, on March 4, the court had to defer its hearing on the bail petition for similiar reasons as the police had failed to submit its case diary.
Saradhamani was arrested by the police late on March 1 night.
She was booked under sections 307 and 120B of the IPC.
1. On 21st Feb 2014 Law Minister Maheswar Mohanty was shot at and injured near his residence in Puri while returning home from a party meeting.
2. On 01st Mar 2014 (after 08 Days) Puri police claimed to have cracked the case by arresting six accused including Saradhamani Mahapatra a 70-year-old lady (mother of the murdered former BJD councilor Talachhu Bhagaban Mohapatra alias Guna Singhari, in the case pertaining to the murderous assault).
3. On 12th Mar 2014 (after 13 days) District Sessions Court, Puri, granted bail to Saradhamani Mahapatra, the 70-year old mother of the murdered former BJD councilor Talachhu Bhagaban Mohapatra alias Guna Singhari, in the case pertaining to the murderous assault on minister Maheswar Mohanty.
4. On 22nd Aug 2012 Bhagaban Mohapatra alias Guna Singhari was shot dead.
5. On 29th Aug 2012(after 07 Days) police arrested the suspect prime conspirator Krushna Chandra Pratihari (in the murder case of Bhagaban Mohapatra alias Guna Singhari) from Koraput district.
6. On 24th Jan 2014 (after 541 days) Krushna Chandra Pratihari was granted bail by Honourabel Supreme Court (advocate For Petitioner was Mr. Pinaki Misra, Senior Advocate), for your kind information Sri Pinaki Mishra is the Member of Parliament from Puri Constituency. Heard learned counsel for the parties.
Leave granted.
Learned senior counsel appearing on behalf of the
appellant states that the appellant is in custody for nearly
seventeen months pending trial. Learned counsel has also brought to our notice that out of six accused, two were granted bail.
Learned senior counsel appearing on behalf of the
impleaded respondent has raised an apprehension about his claim for bail. However, the State counsel has fairly stated that nothing has been alleged against the present appellant. Taking note of all
these aspects and also of the fact that there is no possibility of
trial being concluded in the near future, we are inclined to
consider the claim of the appellant. Therefore, the appellant is
ordered to be released on bail to the satisfaction of the District
and Sessions Judge, Puri in ST Case No.24-38 of 2013, Puri Town PS Case No.117 of 2012 arising out of G.R. Case No. 1726 of 2012. The District and Sessions Judge is free to impose appropriate condition(s) as he deems fit. The criminal appeal is disposed of.
7. All the reader are requested to analyze and can predict the Law and Order situation of Puri.
8. Law Minister of Odisha was shoot by some criminals near his home and the suspect prime conspirator Saradhamani Mahapatra gets bail from District Session Court, Puri after(13) Thirteen days.
9. Bhagaban Mohapatra alias Guna Singhari was murdered near his home and suspect prime conspirator Krushna Chandra Pratihari got bail from Supreme Court, New Delhi after (541)Five Hundred and Forty One Days.

You are right, what Advocate and Puri M.P. Sri Pinaki Mishra said is right but being a Member of Parliament of Puri Constituency Mr. Pinaki Mishra should give his prior attention to the law and order situation of Puri. Talking about the right of the accused person is a lame excuse to hide the mistake he did. There are so many competent advocates in Supreme Court to give their service to release accused persons on bail (in Guna Singhari murder case) why only Pinaki Mishra became the advocate of the accused person? You must carefully note that all the three (M.P., M.L.A. & deceased Councillor) are from one political party hence importance should be given to Srimati Saradhamani’s statement in yesterday’s press conference also, she is an illiterate house wife and mother of deceased person hence her prediction may be correct up to some extent but still I can not believe that Law Minister Maheswar Mohanty can play such dirty politics to defame his image in Puri locality and several question are arising after this press conference,
1. Why Srimati saradhamani has opened her mouth after her arrest?
2. Why she has not taken the shelter of High court till date to get justice?
3. Is it an election propaganda?
What ever may be the reason, it is sure that common citizens of Puri are going to suffer a lot owing to the worst condition of Law and Order in Puri.
