Cuttack, Dec 17:

Five students of three medical colleges (VIMSAR, MKCG & Hi Tech) of Odisha today filed another misc case in the High Court seeking a stay on the counselling and admission of Sardar Rajas Medical College students in other government run medical colleges of the state.

High Court of Odisha

The case has been filed based on yesterday’s recommendation of the Supreme Court that had advised them to approach the High Court on the issue.

Ashok Mohapatra- the counsel of the students has argued that the Supreme Court, in an earlier order on October 30 had stated that its interim order dated September 30 would remain in force until the writ petition is disposed. The interim order stated that the counselling and admission should not be conducted until the hearing is over in the High Court.

He further explained that the Principal Secretary of Health Arti Ahuja herself had submitted an affidavit that students cannot be relocated from a government medical college to a private college or vice versa. MCI also had submitted an affidavit on this count that says such relocation cannot be a permanent arrangement unless the principals of both the colleges approve the transfer.

“The hearing of the case at the Supreme Court has been postponed to January 5. They had advised us to file a petition in the High Court. We have done so today. Given the Supreme Court’s interim order is still in force, I would call such a transfer by the State Government and MCI illegal,” said petitioners' counsel Mohapatra.

It may be noted that, the students had filed another misc case in the High Court earlier praying to put a stay order on its earlier decision that allowed the students of the Jaring based medical college entry into the government colleges.

On the other hand, the counselling for the relocation of Sardar Rajas college was completed yesterday and admission has been scheduled for December 22 and 23 as we reported here.
