SC allows DAV school fee hike

The Supreme Court has allowed fee hike in DAV Schools in Odisha.supreme court 1
The apex court allowed the management of these schools to hike fees with immediate effect in accordance with the recommendations of the fee restructure committee in the controversial DAV school fee hike case.
The Supreme Court, on April 1, had completed  hearing in the case and kept its verdict reserved.
A Bench of the court comprising Justices RM Lodha and Shiva Kirti Singh directed that the DAV College Managing Committee and the concerned educational institutions represented by it shall be entitled to revise their fee structure with immediate effect as per the recommendations of the Fee Structure Committee of Odisha on May 2, 2013
The proposal to hike the fee structures in the DAV schools in Odisha was earlier quashed by the Odisha High Court in June 2011 on the ground that the College Managing Committee failed to justify the fee revision commensurate with the facilities provided to the students.
Challenging the High Court’s  order, the DAV management had filed a special leave petition ( SLP) in the Supreme Court.
While pronouncing its order, the learned bench of the apex court  relied upon the report of the Fee Structure Committee of Odisha, which had reassured the Court that the managing committee and the schools under it have been allowed only reasonable profit to which they are entitled under law.
The Supreme Court also clarified that the existing Managing Committee in the schools constituted under the CBSE bylaws shall continue to manage the concerned schools.
