Police have charged them with Sec 304 IPC (culpable homicide not amounting to murder) against the accused.

The accused were identified as Deepak Barik (20) of Rukuni village, Rajib Sahu (23) of Eadabadi village, Narsingh Sethy (20) of Nuapentha village,(all from Ganjam district), Bijaya Kumar Harichandan (42) of Majhi Sahi under Badagada police limits here, Rajkishore Barik (23), Deepak Kumar Swain (26), both of Jagatsinghpur and Bikash Shil (26) of Sundarpur village under Tangi police limits in Khordha district.

All the accused were staying at Mahishakhal Basti under Badagada police limits here.

According to the investigating officer (IO), Inspector-in-charge (IIC) of Badagada police station, Devi Prasad Patra, Tinku Nayak (25) of Kaptipada village in Mayurbhanj district died today at SCB Medical College and Hospital (SCBMCH) in Cuttack.

Nayak was rushed to Capital Hospital here after he received grievous injuries following the assault by the accused and was later shifted to SCBMCH for better treatment.

The IO said the deceased Nayak, a wanted criminal who was on the run, along with his associate Munna Das arrived Mahinshakhal basti on Tuesday night and started terrorizing the Basti people. The duo abused them in filthy language and threatened to set their homes on fire.

Both ‘out of fear and in self-defence’, the basti people, pelted broken pieces of bricks at Nayak and Das and attcked them with lathis to chase them away from the Basti. They had no intention to commit murder, the IO added, saying, however, Das managed to escape from the spot.

The SI of Badagada R N Panda, who had rushed to the spot after receiving information about the attack, had sustained injury on his back while he was trying to rescue Nayak and Das from the angry slum dwellers, the officer added.

“After conducting the spot inquiry and collecting the witnesses’ statement under section 161 of CrPC, we have arrested seven persons for their involvement in the murder case. They will be forwarded to a local here today,” IO Patra said.

The police have seized blood stained clothes of the deceased and weapon of offence like broken brick pieces, lathi and bamboo poles from the accused.

Search is on to nab the absconding Das, police said.
