Activist files PIL against state govt’s callous attitude towards OPSC

Well-known rights activist and lawyer Prabir Kumar Das has filed a PIL in the Odisha High Court seeking its intervention to ensure the State Government fills up the vacancies of members of the Odisha Public Service Commission (OPSC) in order to discharge its function and render public service in accordance with the mandate contained in Articles 318(1) and 320 of the Constitution and Regulation 3 of the Orissa Public Service Commission (Condition of Service) Regulations,1952.

In his petition, which awaits admission by the High Court, Das has said “the importance of the said commission and the public service being rendered by it can hardly be exaggerated.In conformity with the mandate contained in Article 320 the commission not only conducts examinations for appointments to the services of the State but also discharges various functions and obligations with regard to promotion, disciplinary proceedings etc. pertaining to the civil servants serving under the State Government.

Pointing out that like the OPSC, a number of statutory bodies in the state have been suffering and failing to discharge their duties as per their mandates due to the gross indifference and callousness of the state government, Das has prayed for court’s intervention in the matter.

“It is a matter of public concern that the State Government has always been displaying its indifference and callousness with regard to making the Commission a full- fledged body in conformity with the provisions of law with a view to enabling this constitutional institution to discharge its duties and functions effectively as mandated by the Constitution,” Das’ petition stated.

Das said it is almost a practice that the state government does not fill up the vacancies of the Commission as far as its Members are concerned and that itself showed how seriously the statutory body was being treated by the state government.
