Lulu’s brother moves Odisha HC to substitute as petitioner in poll case

Lalitendu Bidyadhar Mohapatra, younger brother of deceased senior Congress leader Lalatendu Bidyadhar Mohapatra (Lulu) today petitioned the Orissa High Court seeking to substitute him as the petitioner in the Brahmagiri Assembly seat poll case.

The petitioner prayed the court to allow him to substitute against the original petitioner, his deceased brother Lalatendu Bidyadhar under Sub-Section of Section 112 of the Representation of the People Act, 1951, informed Lalitendu Bidyadhar’s lawyer Pitambar Acharya.

According to the Representation of the People Act in an election case in the event of the death of the original petitioner, any voter can petition the court to run the case, since Lalitendu Bidyadhar is a voter in Brahmagiri Assembly constituency he has applied to the court to substitute him as a petitioner in the, he added.

It may be recalled here that defeated candidate Lalatendu had filed a petition against BJD’s Sanjay Das Burma in 2014 alleging adoption unscrupulous means during polling. In the petition, he had cited large-scale voting irregularities by the BJD leader. Lalatendu had prayed the court to declare the poll null and void.

Notably, Lalatendu died on November 6 while undergoing treatment for cirrhosis of the liver at Medanta Hospital in Gurugram.
