Man gets 7 years in jail for killing father in Odisha

Bhadrak: A local court in Bhadrak district awarded a man seven-year rigorous imprisonment for killing his father.

The District and Sessions’ Judge Court, Bhadrak, convicted Jiten Kabi, son of deceased Brundaban Kabi of Hansapur Dhusuri village under Dhamnagar Block in Bhadrak district, under section 304 (a) of IPC and sentenced him to 7 years RI.

According to reports, Brundaban Kabi had two sons Jiten Kabi and Dhiren Kabi. As their ancestral properties were already partitioned between two brothers, Dhiren Kabi, who is the youngest son of Brundaban Kabi, was constructing a new house on a land belonging to his ancestral share. On October 22, 2019, his wife Kalabati was overseeing the construction work of the house when his elder brother Jiten physically assaulted her using abusive terms. When Brundaban tried to prevent Jiten from attacking his daughter-in-law, the latter beat up his father with a crowbar.

The victim was rushed to a hospital in critical condition where he succumbed to injuries under treatment.

Based on a written complaint made by the accused’s mother Pramila Kabi, Dhusuri Police lodged a case under section 307 of IPC and forwarded the accused to the court. Following death of Brundaban, the police changed the IPC section from 307 to 302.

The accused was lodged in jail since 2019.

Hearing the case today, the court realised that the accused had no ill intention to kill his father. Thus, the court awarded 7 years RI to Jiten after convicting him under section 304(A) of IPC, which deals with causing death by negligence or rash acts that does not amount to culpable homicide.

As the economic condition of the accused was not sound, the court had appointed Santosh Kumar Acharya as his lawyer from government’s expenses for the case. Public Prosecutor Pradipta Kumar Samal was managing the case on behalf of the Government.
