Trespassing into judge’s res: Odisha HC issues show cause notice to CBI, others

Cuttack: The Orissa High Court today issued show cause notice to the Central Bureau of Investigation (CBI), Central and State governments and others in connection with the alleged trespassing into official quarters of a sitting judge of the court by the investigating agency.

“We had filed a PIL in the incident. The High Court today issued notices to CBI, Centre, the state and other respondents. The next hearing of the case has been posted to October 16,” said Ashok Parida, president of Orissa High Court Bar Association.

The High Court has asked the CBI to mention on whose permission the latter had visited the residence of Justice C R Dash, the sitting judge.

Notably, the Orissa High Court Bar Association had yesterday filed a Public Interest Litigation (PIL) demanding judicial probe into the incident by a retired Supreme Court judge or by a sitting High Court judge. The PIL was today admitted by the court.

Union Home Secretary, Director CBI, IG CBI, SP CBI, State Home Secretary, DGP, Twin City Police Commissioner, DCP Cuttack, IIC Cantonment Police Station and Registrar High Court were named respondents in the PIL.

The CBI, which was conducting searches in connection with a graft case involving retired Orissa High Court judge I M Quddusi, had allegedly tried to trespass into the official quarters of Justice Dash in the wee hours of Wednesday.

The Twin City Commissionerate police has suo motu registered a case against the CBI in the incident under sections 120(B), 353, 511 and 34 of the IPC based on the report of the security personnel who was on duty at the residence.

The CBI, however, has refuted the allegation of trespassing in a press release.

On the other hand, Orissa High Court lawyers, who were on a cease work since Wednesday, put on hold their agitation today after a meeting of the High Court Bar Association. The next meeting of the body will be held on October 19 and the future course of action will be decided on the day.
